Welcome to Safebox. Our main aim at Safebox is to
prioritise your safety and security along with providing high class security
starting from your way inside the premises covering all the loopholes to prevent any
unconditional or unwanted mishaps through our advanced technological
insights. The safety layers provided by the Safebox includes features with a
variety of safety filters so as to help the owners or Rental Occupants be
conscious and alert of any unwanted or unauthorised person accessing or entering your
premise.
Safebox services is enabled with Blue Collar Verification System and IMSR
[Individual Moral Score Rating] Rating System to keep a watchful eye on the surroundings
of the premise, which further enables to prevent blue collar individual or any
susceptible persons to committing crime.
The main objective of Safebox is to initiate a Cyclical Process of
maintaining High-Security provisions for the respective Housing Complex/society. By
using our Safebox services or opting for our services, you are agreeing to be bound by
our terms and conditions.
The below terms are applicable to all users of the following platforms: onlineverification.safebox.ind.in,
different subdomains operating under the Safebox Umbrella, and the Safebox Mobile Apps
available on Google Play Store & Safebox Apple Store.
Under this User Agreement, ‘Society’ shall mean a Housing Society or Villa
Complex or an Apartment Complex or a Commercial Complex. It can also apply to any
Organisation of Users utilising the ‘Association’, ‘Society’, ‘RWA’.
This electronic record is generated by a computer system and does not
require any physical or digital signatures. By clicking on the “I ACCEPT” button on this
electronic contract, you are consenting to be bound by this User Agreement. Please
ensure that you read and understand all the provisions of this document before you start
using the Safebox.
If you do not agree or accept any of the Terms and Conditions contained
herein, then please do not use the Safebox or avail any of the services being provided
therein.
If this document is not in a language that you understand, you shall
contact Safebox at the email info@safebox.ind.in Failure to do so within 24
(Twenty- Four) hours from the time of receipt of this document and your acceptance of
this document by clicking “I ACCEPT” button shall be considered as your understanding of
this document.
Agreement to Terms
- These Terms of Use constitute a legally binding agreement made between you,
whether personally or on behalf of an entity (“User”) and Safebox, doing
business as Safebox ("Safebox ", “we”, “us”, or “our”), concerning your access
to and use of the Safebox services as well as any other media form, media
channel, mobile application related, linked, or otherwise connected thereto.
- If you do not agree with all of these Terms and Conditions, then you are
expressly prohibited from using the Safebox and you must discontinue your use
immediately.
- Supplemental terms and conditions or documents that may
be posted on the Safebox from time to time are hereby expressly
incorporated herein by reference. We reserve the right, in our sole discretion,
to make changes or modifications to these Terms of Use from time to time.
- The information provided on the Safebox is not intended for distribution to or
use by any person or entity in any jurisdiction or country where such
distribution or use would be contrary to law or regulation or which would
subject us to any registration requirement within such jurisdiction or country.
- The users shall provide their financial data and details for purchasing a
service plan of Safebox only after getting agreed with the terms of use.
- information about you are subject to our “Privacy Policy” which is a
section in these Terms: USER ACCOUNT,
PASSWORD AND SECURITY: You are responsible for maintaining the confidentiality
of the User ID and Password allocated to you when you create your account, and
are fully responsible for all activities that occur under your account.
- You agree to immediately notify Safebox of any unauthorised use of your
password. Safebox will not be liable for any consequence
arising from your failure to comply with this Section.
- You agree that SOS option available in the Safebox App shall be used only in
case of emergencies. You represent that it shall not be used unnecessarily.
Responsible Use
- By using the Safebox, you represent and warrant that:
- all registration information you submit will be true, accurate, current,
and complete.
- you will maintain the accuracy of such information and promptly update
such registration information as necessary;
- you have the legal capacity and you agree to comply with these Terms of
Use;
- you are not a minor in the jurisdiction in which you reside;
- you will not access the Safebox through automated or non- human means,
whether through a bot, script or otherwise;
- you will not use the Safebox for any illegal or unauthorized purpose;
and
- your use of the Safebox will not violate any applicable law or
regulation.
- If you provide any information that is untrue, inaccurate,
not current, or incomplete, we have the right to suspend or
terminate your account and refuse any and all current or future use of the
Safebox (or any portion thereof).
- You are responsible for maintaining the confidentiality of any login information
associated with any account you use to access Safebox. Accordingly; you are
responsible for all activities that occur under your accounts.
- Accessing (or attempting to access) Safebox by any means other than through the
means we provide, is strictly prohibited. You specifically agree not to access
(or attempt to access) Safebox through any automated, unethical, or
unconventional means.
- Safebox does not screen or censor the customers who register on or/and access
the Safebox App. You assume all risks associated with dealing with other users
with whom you come in contact through the Safebox.
You agree to use the Safebox only for the lawful purposes
without infringing the rights or restricting the use of this platform by and the
third party.
- You are solely responsible any consequences, losses, or damages that we may
directly or indirectly incur or suffer due to any unauthorized activities
conducted by you, as explained above, and may incur criminal or civil liability.
- You further warrants that you shall solely be responsible for the
safety and security of the PASS provided by the Safebox
to you, which helps to differentiate between individuals entering your
premises.
Account Terms and Purchase
- In order to make a purchase for a service on Safebox or using the services of
Safebox, you may be required to register with an account on Safebox. You agree
to keep your User ID and Password confidential and will be responsible for all
use of your account and password. We reserve the right to remove, reclaim, or
change a username you select if we determine, in our sole discretion, that such
username is inappropriate, obscene, or otherwise objectionable.
- To complete your Account registration or to facilitates the services e.g. live
data sheets, that enables live tracking of any individual's location in the
premise with highest accuracy, you must provide us with your full legal name,
business address, phone number, a valid email address, area pin code for
shipping and any other relevant information indicated as required.
- You acknowledge that Safebox will use the email address you provide on opening
an Account or as updated by you from time to time as the primary method for
communication with you (“Primary Email Address”). You must monitor the Primary
Email Address you provide to Safebox and your Primary Email Address must be
capable of both sending and receiving messages. Your email communications with
Safebox can only be authenticated if they come from your Primary Email Address.
- We generally send the confirmation mail or notification for the purchase to the
user within 24 (twenty-four) hours after their purchase confirmation. If you
have not received the service confirmation mail, in such case you may contact us
immediately through contact us or by writing mail to us.
- Safebox may provide Vouchers or Coupons to Users for every individual
registration and transaction made by them for being a part of the Safebox
family. Users may need to provide certain information to receive such Vouchers
or Coupons.
Pricing and Payment
- When you opted for our services through Safebox, you agree to pay us the
specific monetary amount as the maintenance charge for rendering Safebox
services or the reflected price on concerned page of the Safebox to facilitates
the services. The final amount required for payment for the services that you
opted will be shown to you immediately prior to making final payment for the
service.
- For that you agree to provide current, complete, and accurate purchase and
account information for all purchases made via the Safebox. You further agree to
promptly update account and payment information, including email address,
payment method, and payment card expiration date, so that your transaction can
be completed. We bill you through an online billing account for purchases made
via the Safebox.
- GST and other applicable taxes will be added to the price of purchases as deemed
required by us. We may change prices at any time. All payments shall be in INR,
if ordered in India, or if an order made outside from India, in such case
payment shall be made in relevant currency.
- You agree to pay all charges at the reflected prices then in effect for your
purchases, and you authorize us to charge your chosen payment provider for any
such amounts upon making your purchase. If your purchase is subject to EMI
basis, then you consent to us charging your payment method on EMI basis without
requiring your prior approval for each EMI payment, until you notify us of your
cancellation.
- We accept the various forms of payment e.g. Debit Card, Credit Card, Net
Banking, NEFT, UPI Pay Later e.g. Simpl through using third party payment
gateway. By using the services, you also accept the third party terms and
conditions mentioned on their individual sites.
Refund and Cancellation
- By opting a service of Safebox, you agree to pay applicable price to facilitates
of such service. After your purchase confirmation Safebox shall facilitates the
service through its App.
- While making any Purchase, you agree to provide us with a valid email address
and other required information, as well as valid billing information. We reserve
the right to reject or cancel an order for any reason, including errors or
omissions in the information you provide to us. If we do so after payment has
been processed, we will issue a refund to you in the amount of the Purchase
price.
- You may also request for cancellation for the Safebox service that you opted
through Safebox at any time as per the Refund and Cancellation Policy of the
Safebox by logging into your account.
- For the detailed terms and condition on the refund and cancellation for a
service, you may visit our “Refund and Cancellation Policy” available on
Safebox.
Prohibited Activities
- You may not access or use Safebox for any purpose other than the purpose for
which we make the Safebox available. The Safebox may not be used in connection
with any commercial endeavours except those that are specifically endorsed or
approved by us.
- No Resale of Service: You agree not to reproduce,
duplicate, copy, sell, resell or exploit for any commercial purposes, any
portion of the Service, use of the Service, or access to the Service.
- As a user of the Safebox, you agree not to:
- Systematically retrieve data or other content from the Site to create or
compile, directly or indirectly, a collection, compilation, database, or
directory without written permission from us.
- Trick, defraud, or mislead us and other users, especially in any attempt
to learn sensitive account information such as user passwords.
- Circumvent, disable, or otherwise interfere with security-related
features of the Safebox, including features that
prevent or restrict the use or copying of any Content or
enforce limitations on the use of the Site and/or the Content contained
therein.
- Disparage, tarnish, or otherwise harm, in our opinion, us and/or the
Site.
- Use any information obtained from the Safebox in order
to harass, abuse, or harm another person.
- Make improper use of our support services or submit false
reports of abuse or misconduct.
- Use the Safebox in a manner inconsistent with any applicable laws or
regulations.
- Engage in unauthorized framing of or linking to the Safebox.
- Upload or transmit (or attempt to upload or to transmit) viruses, Trojan
horses, or other material, including excessive use of capital letters
and spamming (continuous posting of repetitive text), that interferes
with any party’s uninterrupted use and enjoyment of the Safebox or
modifies, impairs, disrupts, alters, or interferes with the use,
features, functions, operation, or maintenance of the Safebox.
- Engage in any automated use of the system, such as using scripts to send
comments or messages, or using any data mining, robots, or similar data
gathering and extraction tools.
- Delete the copyright or other proprietary rights notice from any
Content.
- Attempt to impersonate another user or person or use the username of
another user.
- Harass, annoy, intimidate, or threaten any of our employees or agents
engaged in providing any portion of the Safebox to you.
- Except as permitted by applicable law, decipher, decompile, disassemble,
or reverse engineer any of the software comprising or in any way making
up a part of the Safebox.
- Except as may be the result of standard search engine or Internet
browser usage, use, launch, develop, or distribute any automated system,
including without limitation, any spider, robot, cheat utility, scraper,
or offline reader that accesses the Safebox, or using or launching any
unauthorized script or other software.
Modifications to Service
- As Software as Service product, Safebox offerings will undergo continuous
modifications of its Features and Service. In case any feature or service is
phased out, adequate time and notice will be given to you, so that you may
retain the Information assets created by you as part of that Feature. Beyond the
time given, you agree that Safebox shall not be liable to you or to any third
party.
Contribution License
- You agree that we may access, store, process, and use any information and
personal data that you provide following the terms of the Privacy Policy and
your choices (including settings). And by submitting suggestions or other
feedback regarding the Safebox, you agree that we can use and share such
feedback for any purpose without compensation to you.
- We do not assert any ownership over your Contributions. You retain full
ownership of all of your Contributions and any intellectual property rights or
other proprietary rights associated with your Contributions. We are not liable
for any statements or representations in your Contributions provided
by you in any area on the Safebox. You are solely responsible for your
Contributions to the Safebox and you expressly agree to exonerate us from any
and all responsibility and to refrain from any legal action against us regarding
your Contributions.
Submissions and Feedback
- You acknowledge and agree that any questions, comments, suggestions, ideas,
feedback, or other information regarding the Site ("Submissions") provided by
you to us are non-confidential and shall become our sole property. We shall own
exclusive rights, including all intellectual property rights, and shall be
entitled to the unrestricted use and dissemination of these
Submissions for any lawful purpose, commercial or otherwise, without
acknowledgment or compensation to you. You hereby waive all moral rights
to any such Submissions, and you hereby warrant that any
such Submissions are original with you or that you have the
right to submit such Submissions. You agree there shall be no
recourse against us for any alleged or actual infringement or misappropriation
of any proprietary right in your Submissions.
Affiliated Marketing and Advertisement
- Safebox may engage in affiliate marketing whereby Safebox receives a commission
on or percentage of the sale of Products or Services on or through Safebox. We
may also accept advertising and sponsorship from commercial businesses or
receive other forms of advertising compensation.
- We allow advertisers to display their advertisements and other information in
certain areas of the Safebox. We simply provide the space to place such
advertisements, and we have no other relationship with advertisers.
Privacy Policy
- We care about data privacy and security. By using Safebox, you agree to be bound
by our Privacy Policy which is posted on Safebox digital platform, which is in
consonance with these Terms of Use.
Please be advised the Safebox App is hosted in India. If you access the Safebox
from any other region of the world with laws or other requirements governing
personal data collection, use, or disclosure that differ from applicable laws in
India, then through your continued use of the Safebox, you are
transferring your data to India, and you agree to have your data transferred to
and processed in India.
Term and Termination of Use
- These Terms of Use shall remain in full force and effect while you use the
Safebox. Without limiting any other provision of these terms and conditions, we
reserve the right to, in our sole discretion and without notice or liability,
deny access to and use of the site (including blocking certain IP addresses), to
any person for any reason or for no reason, including without limitation for
breach of any representation, warranty, or covenant contained in these terms of
use or of any applicable law or regulation. We may terminate your use or
participation in the Safebox or delete your account and any content or
information that you posted at any time, without warning, in our sole
discretion.
- If we terminate or suspend your account for any reason, you are prohibited from
registering and creating a new account under your name, a fake or borrowed name,
or the name of any third party, even if you may be acting on behalf of the third
party.
Modifications and Interruptions
- We reserve the right to change, modify, or remove the contents of the Safebox at
any time or for any reason at our sole discretion without notice. However, we
have no obligation to update any information on Safebox. We also reserve the
right to modify or discontinue all or part of the Safebox without notice at any
time. We will not be liable to you or any third party for any modification,
price change, suspension, or discontinuance of the Safebox.
- We cannot guarantee the Safebox will be available at all times. We
may experience hardware, software, or other problems or need to perform
maintenance related to the Safebox, resulting in interruptions, delays, or
errors. We reserve the right to change, revise, update, suspend,
discontinue, or otherwise modify the Safebox digital platform
at any time or for any reason without notice to you. You agree that we have no
liability whatsoever for any loss, damage, or inconvenience caused by your
inability to access or use the Safebox during any downtime or
discontinuance of the Safebox.
Intellectual Property Rights
- Unless otherwise indicated, the Safebox App is our proprietary property and all
source code, databases, functionality, software, website designs, audio, video,
text, photographs, and graphics on the Website (collectively, the “Content”) and
the trademarks, service marks, and logos contained therein (the “Marks”) are
owned or controlled by us or licensed to us, and are protected by copyright and
trademark laws and various other intellectual property rights and unfair
competition laws of the India, international copyright laws, and international
conventions. The Content and the Marks are provided on the Safebox “AS IS” for
your information and personal use only.
- Provided that you are eligible to use the Safebox, you are granted a limited
license to access and use the Safebox and to download or print a copy of any
portion of the Content to which you have properly gained access solely for your
personal, non-commercial use. We reserve all rights not expressly granted to you
in and to the Safebox, the Content and the Marks.
Limitation of Liability
- In no event shall we or our directors, employees, or agents be liable to you or
any third party for any direct, indirect, consequential, exemplary, incidental,
special, or punitive damages, including lost profit, lost revenue, loss of data,
or other damages arising from your use of the Safebox, even if we have been
advised of the possibility of such damages. Notwithstanding anything to the
contrary contained herein, our liability to you for any cause whatsoever and
regardless of the form of the action, will at all times be limited to the
amount paid, if any, by you to us during the six (6) month period prior to any
cause of action arising.
Limitations of Warranties
- By using Safebox, you understand and agree that all Services we provide are "as
is" and "as available". This means that we do not represent or warrant to you
that:
- Your use of Services will be Uninterrupted or Error-free, that Safebox
will review the information and Services delivered through its App for
accuracy or that it will preserve or maintain any such information or
Services without loss.
- Safebox shall not be liable for delays, interruptions, Service failure, or other
problems inherent in use of the internet and electronic communications or other
systems outside the reasonable control of Safebox.
Indemnification
- You agree to defend, indemnify, and hold us harmless, including our
subsidiaries, affiliates, and all of our respective officers, agents, partners,
and employees, from and against any loss, damage, liability, claim, or demand,
including reasonable attorneys’ fees and expenses, made by any third party due
to or arising out of: (1) use of the Safebox; (2) breach of these Terms of Use;
(3) any breach of your representations and warranties set forth in these Terms
of Use; (4) your violation of the rights of a third party, including but not
limited to intellectual property rights; or (5) any overt harmful act toward any
other user of the Safebox with whom you connected via the Safebox.
User Data
- We will maintain certain data that you transmit to the Safebox for the purpose
of managing the performance of our Safebox, as well as data relating to your use
of the App. Although we perform regular routine backups of data, you are solely
responsible for all data that you transmit or that relates to any activity
you have undertaken using the Safebox including your User Id and
Password. You agree that we shall have no liability to you for any loss or
corruption of any such data, and you hereby waive any right of
action against us arising from any such loss or corruption of such
data.
Electronic Communications and Transactions
- Visiting the Safebox, sending us emails, and completing online forms constitute
electronic communications. You consent to receive electronic communications, and
you agree that all agreements, notices, disclosures, and other communications we
provide to you electronically, via email and on the App, satisfy any legal
requirement that such communication be in writing.
- You hereby agree to the use of contracts, orders, and other records, and to
electronic delivery of notices, policies, and records of transactions initiated
or completed by us or via the Safebox.
Spam Policy
- You are strictly prohibited from using the Safebox or any of Safebox information
from illegal spam activities, including gathering email addresses and personal
information from others or sending any mass commercial
emails.
Governing Law
- These Terms shall be governed by and defined following the laws of India.
Safebox and yourself irrevocably consent that the courts at Kolkata, West Bengal
shall have exclusive jurisdiction to resolve any dispute which may arise in
connection with these terms.
Dispute Resolution
- To expedite resolution and control the cost of any dispute, controversy,
or claim related to these Terms and Conditions, the Parties agree to first
attempt to negotiate any Dispute through Mutual Discussion
before initiating arbitration.
- If the dispute arising out of or in connection with this contract is not
resolved through Mutual Discussion shall be referred to the Arbitrator following
the procedure mentioned in the Arbitration and Conciliation Act, 1996. The
number of arbitrators shall be one (1). The seat, or legal place, of arbitration
shall be Kolkata, West Bengal, India. The language to be used in the arbitral
proceedings shall be English.
Entire Agreement
- These Terms of Use, including the documents it incorporates by reference,
constitute the entire agreement between you and Safebox and govern your use of
the Services and your Account, superseding any prior agreements between you and
Safebox (including, but not limited to, any prior versions of the Terms of
Service).
- The failure of Safebox to exercise or enforce any right or provision of the
Terms and Conditions will not constitute a waiver of such right or provision.
